Terms and Conditions for Our Valley Events "Giveaway"
Your participation in Our Valley Events Giveaway (“Giveaway†or “Promotionâ€) shall be deemed to be your complete acceptance of the Terms and Conditions herein. The following are the Terms and Conditions of the Giveaway, which is sponsored by the operator of the Internet site www.ourvalleyevents.com ("Our Valley Events").
1. Only persons over the age of 18 are eligible for entry to the Giveaway. You may be asked, at any stage, to provide Our Valley Events or a third party with proof of age and /or identity. The Giveaway is open to legal residents of the United States. The Giveaway is void where otherwise prohibited or restricted by law.
2. Employees of any vendor participating in The Giveaway and the immediate family members of each are not eligible.
3. The Giveaway shall take place on the date specified on the Giveaway page on www.ourvalleyevents.com.
4. Our Valley Events is not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Our Valley Events that may cause The Giveaway to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in The Giveaway; or (vi) any printing or typographical errors in any materials associated with The Giveaway.
5. Each entrant shall be entitled to make entries based on the Giveaway criteria. In the event that Our Valley Events deems an entrant to have acted in bad faith, as determined in Our Valley Events’ sole discretion, with respect to the Promotion, the entrant shall be excluded from the Giveaway and consequently ineligible to win the Promotional Prize, as defined below.
6. No mechanically reproduced entries are accepted.
7. Prizes will be awarded in a random drawing held from among all eligible entries received. Odds of winning depend on the total number of entries received,
8. The Promotional Prize for winning the Giveaway shall be determined and described in the Giveaway entry box.
9. Our Valley Events shall use its reasonable efforts to notify the winner of the winning via E-mail within forty-eight (48) hours of the Giveaway.
10. Notwithstanding Section 5 above, in the event that, for any reason whatsoever, the Giveaway winner fails to respond within the earliest of thirty (30) days or the expiration date of the Promotional Prize, to the E-mail notification of his/her winning, such winning entrant shall be deemed to have forfeited his / her claim to the prize and Our Valley Events shall not have any obligation whatsoever to compensate the winning entrant in any way.
11. Our Valley Events’ decision is final with respect to all matters relating to awarding of the Promotional Prize and shall not be subject to review or appeal by any entrant or by any third party.
12. Our Valley Events shall not be responsible for the loss or cancellation of the Promotional Prize.
13. Your participation in the Giveaway is considered your agreement that Our Valley Events may contact you.
14. The Promotional Prize is neither transferable nor exchangeable and cannot be exchanged for money or money's worth.
15. By entering the Giveaway each entrant unreservedly agrees to these terms and conditions which govern the Giveaway and the awarding of the Prize.
16. By entering the Giveaway each entrant agrees to release, discharge and hold harmless Our Valley Events, its owners, employees, directors, officers, members, mangers, agents, legal representatives, affiliates and subsidiaries from any damages, claims and/or liabilities whatsoever suffered, alleged or sustained in connection with The Giveaway or the Promotional Prize.
17. The winning entrant shall be solely responsible for any taxes, fees, duties or other costs levied in relation to the delivery or receipt of the Promotional Prize.
18. Our Valley Events reserves the right to alter these Terms and Conditions at any time and in its sole discretion without prior notice.
19. Our Valley Events reserves the right, at any time in its sole discretion, to cancel, modify or suspend The Giveaway.
20. Our Valley Events reserves the right to disclose and or use for a business purpose the Giveaway winner’s name, likeness and/or identity without compensation.
21. Winners may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize.
22. These terms and conditions and any matters relating hereto shall be governed by, and construed in accordance with the laws of Alabama and shall be subject to the exclusive jurisdiction of the courts of Madison County, Alabama.
