1. Introduction/Eligibility

The Pepsi Bobblehead Sweepstakes (the "Sweepstakes") is governed by the following Official Rules. By submitting an entry, Participants (as defined below) or, if they are minors, their parents/legal guardians agree to the terms of these Official Rules. To be eligible to enter the Sweepstakes and receive a Prize (as defined below), Participants must, at the time of entry, meet all of the following requirements: (i) be a legal resident of one (1) of the fifty (50) United States or District of Columbia (“Territory”); and (ii) be thirteen (13) years of age or older as of the date and time of participation (each, a “Participant(s)”). Employees, officers, directors, representatives, and agents of Pepsi-Cola Company, the National Hockey League (“NHL), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), Paragon Marketing Group, LLC., any other company involved in the presentation, administration or fulfillment of the Sweepstakes, and their respective bottlers, parents, subsidiaries, affiliated companies, and divisions (collectively, the “Sweepstakes Entities”) and each of their immediate family members (defined as any spouse, partner, parent, legal guardian, sibling, child, legal ward, grandparent, or grandchild, regardless of where they reside) and those living in the same household of any such person (whether or not related) are not eligible for the Sweepstakes. Void outside the Territory and where prohibited or restricted by law.

3. Sweepstakes Duration

The Sweepstakes will begin on 2/17/24 at 9:00 AM Eastern Time (“ET”) and run through 2/18/24 at 11:59 PM ET (“Sweepstakes Period”). The Sponsor is the Official Timekeeper for this Sweepstakes and all decisions made by the Sponsor are final and binding.

No purchase necessary.

During the Sweepstakes Period, Participants may enter by scanning the QR code available at the Pepsi event booth and provide all required information as follows: Date of Birth, complete first and last name, complete street address and a valid email address on the online entry form (the "Official Entry Form"); If participant does not have the ability to scan the QR code, a tablet or mobile device will be provided to assist

i.  Entering and submitting all required information in the Sponsor's online entry form (the "Entry Form"); or
ii. Sending an email to the address: rbennett@paragonmarketing.biz with the Subject Line, "Official Promotion Entry," and including your full legal name and email address.

Limit of (1) one entry per person/email during the Sweepstakes Period. Multiple Participants are not permitted to share the same email address and/or other accounts used for entry. Any incorrect or incomplete entry is void.

Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents (including Sweepstakes entry services) will void all entries by that Participant. In the event of a dispute as to any online entry, the authorized account holder of the email address used to enter will be deemed to be the Participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holders.

The Approximate Retail Value (“ARV”) of the prize is one-hundred dollars ($100) each . Total ARV for all Sweepstakes prizes is $200.

Odds of winning will vary depending upon the number of entries submitted.

6. Selection and Notification of Winners

The two (2) potential prize winners will be selected in a random drawing from all eligible Participant entries on approximately 2/20/24. Odds of winning depend on the number of eligible entries received .

If the entrant entered via the QR Code then the winner will be mailed their prize to the address provided at time of entry . All winners are subject to verification and the Official Rules.

If the prize is returned or undeliverable then the prize will be forfeited and an alternate winner may be selected. By entering into the Sweepstakes, all Participants consent to the use of their name, photograph, likeness, biography, voice and/or video for advertising and promotional purposes, including online announcements, worldwide and without limitation and without additional compensation, except where prohibited by law.

After notification to the prize winner, the winner's name may be displayed in place of the Official Entry Form wherever published and will be available by contacting the Sponsor’s representative at rbennett@paragonmarketing.com.

7. Privacy

When Participants submit their entries, they may be asked to consent to receive promotional emails and reminders from or about the Sponsor. If you do consent to receive those emails, the use of that personal information, and all personal information submitted, will be subject to the privacy policy of the Sponsor, located at: https://contact.pepsico.com/pepsi/privacy-policy.

8. Governing Law

This Sweepstakes is governed by United States law, and of the Federal Government, and is void where prohibited. In the event of a dispute arising out of this Sweepstakes, the Participant (or if a minor, their parent/legal guardian) agrees that the laws of New York will govern and specifically consents to personal jurisdiction over any such dispute in New York.

9. Severability

The provisions of these Rules are severable, and in the event any provision is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

10. Liability Waiver

The Sponsor, and other participating vendors (collectively with Sponsor, the "Promotion Entities"), their respective affiliates, subsidiaries, parent, advertising and promotion agencies, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruptions, deletions, or defects of any telephone networks, computer online systems, computer equipment, server providers, or software, including any injury or damage to Participant's or any other person's computer relating to or resulting from participation in this Sweepstakes; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly, or are incomplete or lost due to computer or electronic malfunctions or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. All entries become the property of Sponsor and will not be returned.

By entering, all Participants (or if they are minors, their parents/legal guardians) also agree to release, discharge, indemnify and hold harmless the Promotion Entities, the NHL Entities, New Meadowlands Stadium Company, LLC, Delaware North Sportservice, Giants Stadium LLC, Jets Stadium Development LLC, New York Football Giants, Inc., Giants Training Facility, LLC, New York Jets LLC, New Jersey Sports and Exposition Authority, and Metropolitan Life Insurance Company, and their respective parent companies, subsidiaries, their respective representatives and agents, advertising and promotion agencies, promotion partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages or liability arising in connection with each Participant's participation and/or entry in the Sweepstakes and/or their receipt or use of any prize awarded in this Sweepstakes or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any promotion-related activity or participation in this Sweepstakes. Any and all warranties and guarantees are subject to the respective manufacturer's terms.

Participants (or if they are minors, their parents/legal guardians) further understand and agree that all rights under Section 1542 of the Civil Code of California ("Section 1542") and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Participants acknowledge that Section 1542 provides that:

A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which, if known by him or her must have materially affected his or her settlement with the debtor.

The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.
